Bombay HC Directs Fertility Clinic To Preserve Deceased Man’s Semen

The Bombay High Court has issued an interim order directing a city-based fertility clinic to preserve the frozen semen of an unmarried man who passed away, following a plea by his mother seeking to use the sample to continue the family lineage.

The mother approached the court after the clinic refused to hand over the semen, citing the man’s written consent, which directed that the sample be discarded after his death. The man had opted to freeze his semen while undergoing chemotherapy as part of his cancer treatment.

On June 25, Justice Manish Pitale observed that discarding the semen before the matter is fully heard would render the petition meaningless. The court has scheduled the next hearing for July 30.
