Criminal charges were filed against Varun after a footage emerged of him comparing a rival Muslim politician to Osama Bin Laden and threatening to cut the throats of Muslims during a political rally in Pilibhit. Varun, the great-grandson of Jawaharlal Nehru, however, denied making the comments, saying the footage had been tampered with and that he was a victim of a political conspiracy.

Varun Gandhi, son of Maneka and late Sanjay Gandhi, landed himself a criminal case slapped by the Election Commission for an inflammatory speech against Muslims. At an election meeting in Pilibhit Gandhi had said, "This is not not a 'Hand' (Congress symbol), it is the power of the 'Lotus' (BJP symbol). It will cut the head of ....... Jai Shri Ram." He also said if anyone raises a hand against Hindus and if they thought Hindus were weak and leaderless, he would cut his hand. Gandhi, however, claimed that the video footage of his speeches had been tampered with.
