AAP MP Raghav Chadha Moves To Delhi HC Challenging Trial Court's Decision To Overturn Eviction Interim Order

The request for an urgent hearing of the plea was made before a bench comprising Chief Justice Satish Chandra Sharma and Justice Sanjeev Narula, who agreed to schedule the hearing for Wednesday.

On Tuesday, Aam Aadmi Party leader Raghav Chadha took his case to the Delhi High Court, challenging a trial court's decision to overturn an interim order that had previously prevented the Rajya Sabha secretariat from evicting him from the government bungalow allocated to him.

The request for an urgent hearing of the plea was made before a bench comprising Chief Justice Satish Chandra Sharma and Justice Sanjeev Narula, who agreed to schedule the hearing for Wednesday.

Chadha's counsel argued that he had received a notice and eviction proceedings were underway. She noted that there had been a previous stay order from the trial court, but it had since been lifted.

In an order dated October 5, the trial court stated that Chadha could not assert an absolute right to continue occupying the government bungalow for the entirety of his tenure as a Rajya Sabha MP, even following the cancellation of the allocation.

The trial court made this observation when it revoked an interim order issued on April 18, which had directed the Rajya Sabha Secretariat not to remove Chadha from the government accommodation. The court emphasized that the interim relief had been granted to Chadha to ensure that he would not be dispossessed from the premises without due legal process.
