Add yet another twist to the 12-year-old, Rs 64-crore Bofors payoff case. Last week, two separate courts gave judgements that could be significant in that it put the prosecution on the defensive. Its most visible manifestation came in the form of a key accused, Ottavio Quattrocchi, being granted bail by a Malaysian sessions court which rejected India's appeal for extraditing the Italian businessman to stand trial in India. The court found that the description of offences were "insufficient, vague and ambiguous".

The same day, India's Supreme Court stayed the trial proceedings before a special court against the Hinduja brothers—allegedly the other key beneficiaries of the Bofors kickback. In this case, the Supreme Court amended its own earlier order of July 29, 2002, which had allowed the trial proceedings to continue.

Even as the CBI through diplomatic channels moved the Malaysian High Court against the ruling of the sessions court, the decision has come as a dampener for Indian investigators. "We will pursue all legal methods," said O.P. Galhotra, the dig in charge...
