Addressing a press conference in New Delhi, Smriti Irani, referring to the Sohrabuddin encounter case, said the Congress used the CBI to frame Amit Shah.
The case attracted much attention as BJP chief Amit Shah, who was Minister of State for Home in Gujarat at the time of the incidents, was one of the accused before being discharged in 2014.
The petition was filed by Bombay Lawyers Association questioning the CBI's decision not to challenge the discharge granted to Shah in the case.
The CBI had booked these officials, along with 33 other people, as accused in the "fake" encounters of Sohrabuddin Shaikh, Kausar Bi and Tulsiram Prajapati
A single bench, presided over by Justice A M Badar, was conducting hearing on a daily basis on the five revision pleas since July 4 this year.
Sheikh and his wife Kausar Bi were allegedly abducted by the Gujarat police's Anti-Terrorism Squad from Hyderabad on their way to Sangli in Maharashtra in November 2005.
Three revision petitions filed by Sohrabuddin's brother Rubabuddin, and two petitions filed by the CBI were earlier being heard on a daily basis by Justice Revati Mohite-Dere.
The trial court had passed an order prohibiting the media from publishing or printing or telecasting information pertaining to the trial proceedings.
A bench of justices Arun Mishra and MM Shantanagoudar asked Maharasthra Government counsel Nishant R Katneshwarkar to file reply by January 15.
"His (Loya's) family feels very strongly that there was some foul play in his death.," he said.
Looking at how the Amit Shah case has been managed, the possibility of other fake encounter cases falling apart is very real.
