A division bench comprising justices M Ramachandran and K T Shankaran, dismissed the petition.
Another bench of the High Court had on April 1, 2002, decreed that Roy, mother of writer Arundathi Roy, should have 1/6th share of the property of her late father.
Challenging the judgement, Roy's brother, George Issac, filed a review petition in the court, which was dismissed today.
Dismissing the petition, the court said while dividing the property entire property left behind by the father has to be reckoned with.
The property alienated after the death of the father should also be included while computing the share.
Roy's father had expired in 1960. In 1959, the property was transferred in his wife's name and she was given 'life interest' in the property.
After her death, her children would get equal share of the property of their deceased father, the court had ruled.
