Additional Chief Metropolitan Magistrate Samar Vishal said the allegation against Gambhir was "baseless and not legally sustainable".
The court said: "There is no evidence on record to show what, if any, false statement was made by Gambhir which may amount to an offence under section 31 of Representation of People''s (RP) Act."
It further stated that the violation of section 17 (no person can be registered as voter in more than one constituency) of RP Act "does not create any penal liability and, therefore, merely because a person is registered as a voter in more than one constituency, it does not amount to any criminal offence".
The court had earlier asked Marlena to prove her locus standi for filing the petition against Gambhir.
The plea, filed by advocate Mohd Irshad, alleged that Gambhir has enrolled "deliberately" and "illegally" as a voter in Karol Bagh and Rajinder Nagar Assembly segments. PTI UK SA
