UP RERA Slaps Penalty Of Rs 1.39 Crore Against 13 Real Estate Promoters

The Uttar Pradesh Real Estate Regulatory Authority has imposed Rs 1.39 crore fine against 13 property promoters for non-compliance with its orders, it said in a statement on Wednesday.  

The decision was taken at the 115th meeting of UP RERA under the chairmanship of Rajive Kumar on February 15, 2023. The body reviewed the compliance status of its orders by the promoters. 

The authority heard 22 cases related to project registration, project extension, and non-compliance with the “model agreement for sale” notified by the Uttar Pradesh government.  

The meeting, also attended by members, T. Venkatesh, Deepak Swaroop Saxena, and secretary Rajesh Kumar Tyagi, expressed displeasure that some promoters have not complied with its orders despite granting sufficient time to follow through with its directives.  

In a press release, UP RERA chairman Rajive Kumar has warned that the authority will take strict action against the “insensitive promoters” to protect the interests of home buyers.  

He said it will make constant efforts and take all possible steps to ensure the enforcement of its orders, provide speedy justice to the aggrieved allottees, and regulate the sector as per the RERA Act. Meanwhile, the guilty promoters were asked to pay Rs 1.39 crore for non-compliance with its orders.  

“Taking the facts into account, the authority decided to impose an appropriate penalty against the promoters to ensure compliance of its orders and protect the interests of home buyers,” it said. The action against them, it said, is an important step towards forcing them to comply with the orders.  

The authority has used its powers under section 38/63 of the RERA Act, which empowers it to penalise the non-compliant promoters with up to 5 per cent of the project cost.  

Those penalised included Sikka Infrastructure Pvt., Ltd., Gardenia India Pvt. Ltd., HeBe Infrastructure Pvt. Ltd., Parsvnath Developers Pvt. Ltd., Parsvnath Developers Pvt. Ltd., Shubh Advertisers Pvt. Ltd., Solitaire Infrahomes Pvt. Ltd., Supertech Township Projects Pvt. Ltd., Uppal Chaddha High-Tech Developers Pvt., Ajnara Realtech Limited., ATS Realty Pvt. Ltd., Mahagun (India) Pvt. Ltd., Lakshya Realinfra Pvt. Ltd., and Capital Infratech Homes Pvt. Ltd.  

The authority has directed the promoters to deposit the penalty sum within 30 days, and failing which, it would be recovered as arrears of land revenue. It also directed them to submit a compliance report of its orders within 15 days.
