Vijay Patil, a 49-year-old restaurant owner from Kolhapur, moved the Bombay High Court challenging his detention and seeking damages from Police for arresting him under section 151 of the CrPC which allows police to arrest a person without a warrant or a court order, as the only means to prevent a serious crime from taking place.

Apparently, on February 22, at around 11 am, when Patil was sipping tea at a tea stall in Kolhapur, he was accosted by Sub-Inspector Jadhav and asked what he was doing.

His reply that he was merely drinking tea was clearly not satisfactory for the sub-inspector who took him under preventative detention.

However, Mr Justice Gautam Patel, at Bombay High Court, was so not impressed, and went on to observe, inter alia:
