MIM MLA Owaisi Sent to 14 Day Judicial Custody

MIM legislator Akbaruddin Owaisi, accused of sedition and criminal conspiracy for his "hate speech", was today sent to jail for 14 days by an Adilabad court which rejected his petition for shifting him to a hospital even as police slapped additional charges against him.

42-year-old Owaisi, who was arrested last evening, spent the night at the police station in Nirmal, about 200 km from Hyderabad, and was produced at 5.30 am before the magistrate who sent him in judicial remand till January 22.

The police today moved an application before the court seeking seven days remand of Owaisi, leader of MIM legislature party in the legislative assembly and younger brother of party chief and MP Asaduddin Owaisi, on which the magistrate asked the MLA to file a counter affidavit and posted the matter for tomorrow.

Owaisi has been lodged at Adilabad district jail, about 80 km from here.

Additional Judicial First Class Magistrate Ajesh Kumar rejected two petitions filed by Owaisi's counsel urging the court to shift him to Banjara Hills hospital in Hyderabad for better treatment and also for moving him from Adilabad district jail to Chanchalguda jail in the state capital.

The magistrate dismissed both petitions as "not maintainable" and directed Adilabad jail superintendent to provide best available medical facilities to the MLA.

In its remand application, the police slapped additional charges against Owaisi under five different sections of the IPC.

The additional charges include 120-B (criminal conspiracy), 295-A (deliberate and malicious acts intended to outrage religious feelings of any class by insulting its religion or religious beliefs), 124-A (sedition), 188 (disobedience to order duly promulgated by public servant) and section 505 (statements causing public mischief).

Owaisi had earlier been booked under IPC Section 121 (waging or attempting to wage war, or abetting waging of war, against the government of India) and 153A (promoting enmity between different groups on grounds of religion, race, place of birth, language etc and doing acts prejudicial to maintenance of harmony).

FIRs were registered against Owaisi in Adilabad and Nizamabad districts after the legislator had allegedly used inflammatory and derogatory language against a particular community during his public speeches last month, while the Osmania University police in Hyderabad booked him subsequently following a court directive.

There was tension in Adilabad and Nizamabad districts where a bandh was called by MIM against Owaisi's arrest. Most shops and business establishments in several localities of old city in Hyderabad, whose Chandrayangutta seat he represents in the state assembly, remained closed.

Owaisi was arrested yesterday following a series of medical tests soon after he sought four days time to appear before the police citing health reasons.

Meanwhile, Andhra Pradesh High Court today posted to January 21 a petition filed by Akbaruddin seeking a direction to the state government and the DGP not to register any further FIRs against him over his controversial speeches.

He has also sought quashing of cases registered with Osmania University police station.

 Hate speech not new for Owaisi clan

HYDERABAD: For the Owaisi family, the arrest of Akbaruddin is a case of history repeating itself because the young MIM MLA from Chandrayanigutta is not the first person from the Owaisi family to have been arrested for making inflammatory speeches. Akbaruddin's grandfather, Maulana Abdul Wahed Owaisi, had ended up in Chanchalguda Jail for more than 11 months for making similar inflammatory speeches about 56 years ago.

Abdul Wahed was arrested on March 14, 1958, under orders issued by the Hyderabad police a day earlier under section 3 (1) read with sub-section (2) of the Preventive Detention Act, 1950. The police booked Abdul Wahed Owaisi for "Rousing or attempting to rouse communal passions and creating or attempting to create panic, resentment or hatred in the minds of the Muslims against the State and the non-Muslims as disclosed by his speeches made by him in public meetings" on 5th, 12th, 23rd and 24th October 1957, 15th November 1957 and January 9, 1958.

At the time of the arrest, Owaisi was the president of the MIM which he had inherited from Qasim Rizvi in 1957 when the latter migrated to Pakistan.'

MIM was formed by Kasim Rizvi the Head of Razakars who was instrumental in forcing Nizam to opt for Pakista .Kasim Rizvi wa shea dof Razakars who killed Hindus in 1947-1948 pre Police Action . Abdul Whaid Owasi and Kasim Razvi were together in MIM.

Abaru Owasi surrendered as he knew he will be out with two weeks inspite of being charged with Non Bailable Sections.

By the way is Akbar Owasi in Jail -which Jail or is in Hospital but most likely is  in some rest house ??? Where is he ???

MIM must be legally banned for Anti India stand of theirs and provoking enmity with other communities ! surprisingly this party got a seat next to UPA chairman during their formal meetings with one MP, all in the name of secularism!  I think interchanging the meaning of secularism with crude communalism is what the UPA stands for!! It’s a Shame!

No doubt, Owaisi's speech was inflammatory to the core (browse ) . However, it wud be futile to counter the hate speech by Akbaruddin Owaisi with another hate speech by the likes of fundamentalist Hindu leaders from RSS, VHP and Bajrangdals.
The moment you start arresting them and getting excited about the speech, the cameras and mikes will come in hordes to amplify and spread the story all over to the disparate masses with lots of spices added, ultimately resulting in rioting and arson.
