Court Hears Petition Against Owaisi for 'Hate' Speech

A Hyderabad court will tomorrow deliver its verdict on a complaint against Majlis-e- Ittehadul Muslimeen (MIM) MLA Akbaruddin Owaisi, who is at the centre of a controversy for allegedly making a "hate speech" against a particular community.

Several political parties have strongly condemned Owaisi's remarks, accusing him of using inflammatory and derogatory language in his speech while addressing a public meeting (MIM Jalsa) at Nirmal town of Adilabad district last month.

Additional Chief Metropolitan Magistrate's court heard the application of Kashimshetty Karunasagar, a practising advocate, who claimed he was being threatened over phone since he filed the complaint against Akbaruddin and requested the court to hear the case directly.

The court posted the matter for hearing tomorrow when it will deliver its order on whether to direct the police to file an FIR against Akbaruddin over the provocative speech, as alleged by the petitioner, or should it take direct cognisance of the offence and issue summons.

Karunasagar had filed a complaint on December 28 in the court seeking registration of a case against Akbaruddin under Section 295-A (deliberate and malicious acts, intended to outrage religious feelings of any class by insulting its religion or religious beliefs), 153-A (promoting enmity between different groups on grounds of religion) and other relevant sections of the IPC.

In Delhi, social activist Shabnam Hashmi today filed a complaint against Owaisi for his "highly objectionable and inflammatory" speech.

Hashmi filed the complaint in Parliament Street police station drawing the attention to the speech of Owaisi made on December 24.

In her complaint, she alleged that "the whole speech is highly objectionable, inflammatory" and against country's cultural heritage.

Earlier, during the hearing, Karunasagar told the court that he had been getting threatening calls for filing the complaint against the MIM legislator.

The petitioner requested the court for speedy disposal of the complaint by taking direct cognisance of the matter rather than referring it to police.

"There are several complaints pending with police against him (Akbaruddin) in different issues and hence the court should itself take cognisance and issue summons against him," he said..

MIM President and Lok Sabha MP from Hyderabad Asaduddin Owaisi, brother of Akbaruddin, told mediapersons that his party would abide by the court order, whatever it be.

"The matter is sub-judice and I will not comment more on this", he added.

Congress spokesperson Rashid Alvi said law will take its own course in the matter.

"Law will take action against Owaisi if he has broken it. It will take its own course," Alvi said when his attention was drawn to the complaint filed in a Hyderabad court.

Soon after the MIM parted ways with the Congress party a couple of months back, it has tended to become more aggressive in asserting its religious identity, political observers feel.

A delegation of the BJP unit in Andhra Pradesh led by its president G Kishan Reddy submitted a memorandum to Chief Minister N Kiran Kumar Reddy demanding action against Owaisi.

Congress leader Digvijay Singh said action must be taken against any person who makes such a speech.

"Such people must be shunned out of public life for good," said BJP's Balbir Punj.

Kamal Farooqi of SP said the country cannot afford to have hatred among various communities.

I am of course an absolutist in terms of "freedom of speech and expression" - this is either a fundamental right - no ifs and buts (US style protected by the constitution) or it is useless to say "we have freedom of speech and expression". So whether it is Varun G or Owaisi or Togadia or whoever - I might vehemently disagree with them, consider then fruitcakes from la-la land, hope they end up in a asylum or loony dustbin of history but I would much rather have them say what they feel rather than hide it. I would much rather hear and see their ugliness in it's full glory rather than hidden.

These laws about "hurting sensibilities", "provoking enmity between groups" should go. They make us adult citizens get treated like children and in return we end up behaving like children - making it is a self fullfilling prophecy.

For course, the real problem I would like to see solved in that our law and order machinery does not allow the "thoughts and feelings" to be acted upon and when tried the heavy hand of law falls on them. I know we are a million miles away from this ability to implement "rule of law" but I would much rather still solve that problem then "ban", "arrest", "censor" and what not. Essentially ensure the population never grows up to be adults - remain adolscent and putty in the hands of the "powers that be" - desi ones at that who given any opportunity to excercise power will use for personal good and larger detriment than for the larger good - barring of course a saint who comes along once in a thousand years - we honor, respect, pray to but don't follow even one bit.

According to 'Hate Hindu' Sonia Gandhi,MIM is a secular party.This definition alone gives all the strength to rogues like Akrabuddin to make such rabid anti-Hindu speeches.The Muslim League of Kerala is another of Sonia's inner circle secularists.Blame the Hindus for being so stupid and blind to be ruled by this UPA government.

I have  heard the entire speech, its worst than Kasab's bite....he should be shown the fate of Kasab! least put him in prision under national security act! shame on entire secular crooks for not raising the issue, to me all secular crooks perhaps subscribe to that ideology
