Outlook India : Ranjit Sinha Is the Next CBI Director

Congratulations to Ranjit Sinha on his appointment as Director,CBI.One hopes, he maintains the dignity of high office and withstand all pressures.
However, with the infighting going on within the IPS cadre and one hopeful having approached the CAT for redrassal of grievance, the selection of new CBI chief has got mired in controversy.This could be attributed to : (a) Arbitrary selection process; (b) Anomalous recruitment rules( RRs) and ( c) The privilege of decision making authority lying with the ruling dispensation. A transparent, non-partisan selection in the present scenario, is .The lacuna has hit the credibility of the premier investigative agency. The practice of shortlisting of candidates left to the committee headed by CVC with Cabinet Secretary and the outgoing Director CBI as Members,is simplistic. It could mere...ly facilitate selecting an officer, who would be always willing to truncate and influence the investigations at the behest of political masters.Associating the Cabinet Secretary with the CVC’s committee,is per se wrong as the former is Secretary to the ACC,the final arbiter. Worse, associating the outgoing CBI Chief with selection of the incoming chief may bring in biases and prejudices.Reforms in selection process are needed.It is time the R/Rs for the post of Director ,CBI are amended to insulate the premier investigative agency from political interference and maintain its dignity. As per Supreme court’s directions,the post of Director CBI is to be filled from the IPS cadre.
Against this background,it will be ideal if the selection is conducted in three stages as follows: (i) The short list should be prepared in a transparent manner by a committee of all DGs in the country,based on general reputation of eligible candidates, their finest qualities of head and heart and,of course,their seniority;(ii) The CVC may be asked to provide vigilance clearance in respect of shortlisted candidates (iii) The shortlisted candidates may be interviewed by the collegium headed by the PM with LOP (LS)and the CJI as Members.The selection should be finalized by the collegium on the basis of consensus with provision for dissenting Notes. Taking approval of the ACC is an administrative necessity before issuing formal approval.
The above suggestions merits attention of the government so that the entire controversy is set at rest for the future.
