Naroda Patiya Riots: Maya Kodnani Gets Bail

Former Gujarat minister Maya Kodnani, sentenced to 28 years' imprisonment in the 2002 Naroda Patiya massacre case, was today granted bail by the Gujarat High Court, mainly in consideration of her health.

"Applicant is hereby ordered to be released on bail on executing bond of Rs one lakh and subject to the condition that she shall surrender her passport before the trial court," the division bench of Justices V M Sahai and R P Dholaria said in its order.

Kodnani, once a minister in the erstwhile Chief Minister Narendra Modi's ministry, becomes the first convict to get bail in the Naroda Patiya case in which 97 people were killed. She was the first woman to be convicted among the accused of Gujarat riot cases.

The bench has also allowed Kodnani's prayer of suspension of the sentence until her appeal, pending before the High Court since December 2012, is heard.

Her bail application said she was suffering from tuberculosis and depression, for which she was getting treatment at the city civil hospital. The contention was supported by certificate from the hospital superintendent.

Special public prosecutor Prashant Desai, who represented the Special Investigation Team, opposed the bail plea.

"Looking at the crime where a large number of people died and were injured, the court should not be liberal in grant of bail application and should view the matter very strictly and looking at the seriousness of the offence... Bail plea is liable to be rejected," Desai said.

The High Court said it would not deal with merit of the evidence against her now. "We deem it proper not to enter into a great detail of the evaluation of the evidence on the record as it will be seen at the time of final hearing of the appeal," the order said. 

Kodnani, MLA of Naroda at the time of 2002 riots, was made minister of state for women and child development in 2007. She had to resign after her arrest in the case in March 2009.

The SIT court in August 2012 awarded life imprisonment to Kodnani, Bajrang Dal leader Babu Bajrangi and 29 others for the riots at Naroda Patiya here.

The massacre had taken place a day after the Godhra train burning incident of February 27, 2002.

Mayaben Kodnani granted bail by Gujarat High Court. Not surprising news. Her ill health, depression, mental condition etc. weighed with High Court which has observed that the charge of conspiracy u/s 120B is not proved beyond reasonable doubt. Her sentence is suspended.
My client Maulana Ibrahim Umarji was arrested in 2003. He was also charged u/s 120B. He was branded as the chief mastermind behind Godhra carnage. He was not granted bail by the Godhra sessions court. POTA was slapped on him. POTA court also refused bail. High Court did not grant bail. Supreme court also refused bail. He languished in jail for 10 years. Only because he was Muslim. Finally declared he was innocent and acquitted. Now he is dead.
Since he was Muslim, all efforts were made to ensure that he was not released on bail, whereas for Mayaben, all efforts are made to ensure that she is granted bail and her sentence is reversed.
Jesus Christ said - all are equal in the eyes of God. Ambedkar's Constitution said - all are equal in the eyes of law. Unfortunately in Gujarat, the criminal law is not equal and uniform for all. The standards are different for Hindus and Muslims. We do not need uniform civil code. All that we need is uniform criminal code.

Why is Saroja mami getting hemorrhoids if Maya Kodnani gets bail. When the judiciary does something they don't like, they immediately cast aspersions on the integrity of our justice system. But when the same judiciary convicted Kodnani, there was deafening silence and not even a perfunctory acknowledgment that the judges did their job. Life as a secularist must be extremely tough because of the two-facedness you have to constantly maintain!

I thought such incidents were only possible in Pakistan. This is the effect of 65 years appeasing policies of Congress.

On 4th May one Biren Pal of village Hazarpur expired and his relatives took the mortal body of Late Biren Pal to Arjunpur Samshan Ghat for cremation. Immediately the local Muslims started disturbance to take away the body in other place for cremation as burning of the mortal body is not permitted in Islamic belief. As Hindus protested and started the cremation (burning rituals), the fanatic Muslim charged two bombs and Hindus compelled to flee leaving the half burnt dead body on the pyre in the Samshan ground.
