While the SC judgement upholds the right to protest as a fundamental right of speech and assemble, it shakes the foundation of the fundamental right by laying down a highly doubtful proposition that once the right to protest is denied the protester must meekly accept the denial.

Well put. The judgement, taken as a whole, does not make much sense.

As always, Mr. Jaitley is brilliant and he has raised a fundamental issue about a citizen’s right to protest. However, two points need to be made here. First is who will bell the cat? Who can approach the Supreme Court requesting it to reconsider its own decision, without an appropriate occasion? Secondly, a State is always a powerful authority and it is extremely difficult to fight against the injustice inflicted by a State agency on an individual or a group of individuals. If the group is larger, at least a fight is possible. But here again the response of the Courts has not been consistent. I am aware of a case of clear injustice in a labour dispute, where the State was the employer. It is extremely difficult for individuals to fight against the State. This of course is not a happy situation at all but nevertheless a bitter reality.

Seems strange and shameful, but the justices of SC had to throw a piece of meat to UPA government after their stern verdict on 2G cancellation.  Hence Baba Ramdev was blamed 25 per cent.  I doubt that in any other circumstances, the wise justices of SC would have given such 'Lolly-Pop' verdict wchich can be attacked so easily.

3000 to 4000 people were killed in Tiannamen Square. Delhi police did not kill even one of the protesters in Ramlila Grounds. A woman died from injuries resulting from the stampede.

Mr Jaitly the Manmohan Govt simply wanted to send the simple message that because his Sarkar and Mantries are sleeping so at least the people of India should remain awake .

That is all .No ulterior motives were behind the tear gassing and Lathi charge .It was the call :

A large part of Indian judiciary incliding SC is part of problem that india faces today.

The same judiciary had upheld that beating of daughter-in-law by mother-in-law does not amount to torture.

The same judiciary granted freedom to Lalu yadav.

The same judiciary has sameless ex-CJI. Our lord, honourable Mr Balakrishnan, whom the lawyers always made prayer during his tenure, is unwilling to vacate NHRC chief post. He consistently

Why these people are not hanged when they deliver wrong judgement? The amount of national resource and respect they consume, on commiting mistake while delivering Judgement they should be deemed as most dreaded criminal.
