Following the Vodafone verdict, it’s feared that the government may make amendments in the Income Tax Act to make transactions like the Vodafone deal liable for I-T, which may adversely affect foreign investments. If the government has to follow this line, it’ll be better if it gives exemptions with riders—like funds saved thus be put to use in future (within a specified time, say 3-5 years) in India. A separate audit can be made for use of such funds in India.

Nowhere in the civilised world would the Vodafone deal have attracted capital gains tax.
