Opinion COMMENTS
Recent cases underline the need for independent Constitutional bodies for the appointment of judges as well as for investigating complaints against them. These cannot be in-house bodies of judges and must be completely independent of the judiciary as well as of the government.

"The inaction of the government in Justice Sen’s matter displays the complete lack of seriousness on the part of the government in enforcing judicial accountability"

Half of the politicians are implicated in court cases. Some may be genuine but most are result of political rivalries and overly willing judges. That's why politicians don't dare to act against judge's interest.

Why judges are unwilling to disclose their assets is also obvious. Given secrecy in appointment and lack of accountability thereafter, one can only image the enormity of greed, corruption and bribery involved. I bet there are number of scams hidden in the judiciary, each bigger than fodder and other scams in the government.

Judges are not paid from special account where money comes from heaven, they are also paid by public money. If the existing law doesn't allow them to disclose thier assets,we have to amend it immediately without any concern.

Verdicts announced by the judeges who commited crimes or violated laws doesn't make any sense. This is the serious issue.

What accountability!

Indian judiciary, law enforcement and investigative agencies, and even enquiry commissions headed by retired judges have master-slave relationship with the governments in power.

Prashant Bhushan seems to offer a cure that is worse than the disease. What are we to make of his call for a body that is independent of the judiciary and the government itself? Wouldn't this body too in due course, given the ills within hte system, suffer compromise? Instead a solution must be found within the existing mechanisms provided for by the Constitution, that although in India does not draw a bold line between the Executive and the Legislature, still does between the those two and the judiciary. What we need is a parliamentary committee that holds an open confirmation process. Where corruption is concerned we have enough laws in the books to prosecute the judiciary where required. But is the executive up to the task?

The judiciary is not above the law- like the other branches of govt(legislative and executive) they too must conform to the requirements of the law- all public officials must declare their assets - no exceptions!

Our pride lies in being a part of the world's largest democracy. But it is really unfortunate that our highest level of judiciary is shrouded with clouds of intransparency and reclusiveness when it comes to appointment of judges. It is a big job to deliver justice to the common man irrespective of his cast, creed and social status. And if we are not sure about our Judges' integrity and commitment towards the society, our belief in the judiaciary will be damaged beyond repair. So it is very important to devise a proper system of appointing judges. The system is already rotten to the core, and something needs to be done before it is dead.
