'A Cover-Up Operation'
It's a scam involving close to Rs 60,000 crores and the BJP is on the offensive: 'It is unfortunate that the Prime Minister has chosen to comment on the innocence of the minister even while the investigations are on'

The Central Bureau of Investigation has registered a regular case with regard to the allotment of spectrum for the 2-G license issued by the Department of Telecommunications in 2007. Offices of the Department of Telecommunications have been searched and various documents have been seized. Even when the investigations were going on and the accusing finger categorically points to the Telecommunication minister, A. Raja, the Prime Minister has today made a statement that the allegations against the Telecom minister A. Raja were not correct. He has further said that whatever the Opposition says is not always correct. To Shri A. Raja’s statement that he had kept the Prime Minister informed of what he was doing, the Prime Minister has said – “ I would not like to join issue in  public with my Cabinet colleague.” Obviously, the Prime Minister is in no position to agree or disagree.

The allegations against Shri A. Raja and the officers of the Department of Telecommunications are very clear. In 2007 an open license regime was recommended. Applications for telecom licenses were invited setting 1st October, 2007 as the deadline. The first allegation is that even when applications were invited till 1.10.2007, an artificial cut-off date i.e. 25.9.2007 was created and applications received between 25.9.2007 and 1.10.2007 were summarily rejected and not considered. Rules of the game were changed after the game had begun. All friendly applicants, mostly real estate companies had been advised to put in their applications on or before 25.9.2007. This is not the Opposition’s charge as the Prime Minister has commented. It is now a judgment of the Delhi High Court, which has quashed the fixation of these cut-off date wherein many experienced players were left out and 9 licenses were issued to relatively inexperienced parties. 

The next allegation relates to the amount to be charged for the licenses and the spectrum allocation from these 9 operators. The license is merely an entitlement to operate the service. The physical operation can commence only after the allotment of spectrum. Together, the two were allotted at a price of Rs. 1650 crores per operator. This price was taken not on the basis of the 2007 market value of the license but on the basis of an auction held in 2001which determined the 2001 price. Thus, a valuable public asset was being allotted in 2007 at a 2001 price. The minister’s contention that the TRAI had recommended this is wholly erroneous because the TRAI had recommended that “the entry fee determined in 2001 is not the realistic price for obtaining the license. Perhaps it needs to be re-assessed through a market mechanism.” In any case a government asset should ordinarily be sold through an auction. The value of the license and spectrum in 2007 could not be the same as in 2001. The telecom market has grown phenomenally during this period. Obviously, the government and the Public Exchequer suffered a loss. The quantum of loss suffered in this case is easily determinable. The allotees post allotment did not operate the service. All that they owned was a shell company and a guaranteed spectrum. They availed the 74% FDI policy of the government and found buyers/ joint venture partners from the international market. The companies were overnight valued at over 200 billion dollars (over Rs.9000 crores) and a large chunk of the equity was sold by at least 3 licensees to overseas partners at a price of Rs.6000- 7000 crores. If the value of spectrum in each case was over Rs.9000 crores, obviously the government lost over Rs. 7000 crores per each license. For the 9 licenses collectively along with the spectrum, the net evaluation exceeds Rs. 60,000 crores. 

This loss would be further compounded because the additional spectrum being made available in the market at a throw away price would suppress the value of the 3-G spectrum for which the government now plans an auction. If auction can be held for the 3-G spectrum in accordance with the decision of the EOGM why was the same principle was not followed while allotting the 2-G spectrum. 

The Bharatiya Janata Party had raised the issue in Parliament in the Monsoon Session. The Party had demanded that under section 13(1)(d) of the Prevention of Corruption Act, a public servant is said to have committed an offence of criminal misconduct if he by corrupt or illegal means gets for himself or any other person a valuable thing or a pecuniary advantage. This provision provides for a 7year imprisonment. It is clear that the crucial decisions in case were taken by the minister himself. The minister, Shri A. Raja is primarily liable for this offence. 

It is unfortunate that the Prime Minister has chosen to comment on the innocence of the minister even while the investigations are on. There was no occasion for the Prime Minister to send such a signal to the investigative agencies directly under him. The fact that the minister belongs to an alliance partner of the UPA could not be a ground for a cover-up operation. This country has been robbed of a large amount of money by this misdemeanour of the Telecom Department. The compulsions of the coalition politics should not come in the way of an honest investigation. Propriety requires that while the investigations are under way, the minister should cease to be in office. His continuation in that ministry is itself a deterrent to an honest and independent investigation. The entire Nation is closely watching this investigation. Let this investigation not result in holding civil servants guilty and the minister innocent. It was the minister who is the prime accused and the civil servants were only carrying out his dictates.

Yes graft is everywhere but nowhere we see people defending the graft on premise that graft is everywhere so it should be ignored. Whenever and whereve graft happens people in power pay.. Here iN canada liberal govt of 12 years is down in dumps due to graft, people are not saying hey graft is everywhere so why bother let us keep electing liberal goverment

(1) we didn;t release Quttorhci 's money opnly to be told yes you released then excuses followed.. bottomline this saint Manmohan Singh didn;t have to life if he was not hiding anything

All forms of corruption are evil. But providing means to indulge in corruption is as evil as the corruption itself and BANKS which provide secret account facilities indulge in it. The "hearts that bleed for the poor of the world" NOT doing anything to prevent occurrence of gross injustice to the poor- "for whom their hearts bleed"- resulting in poverty, hunger, and suicide is what is being highlighted. "Shivraj does or Raja does" the medium which provide the "hidden route" is same and then proudly state that it is their state policy not to disclose the details of such account holders. Aren't the BANKS in which "blood money" is deposit- that is what it is- money grabbed from the mouth of starving millions- responsible for more death than the TERRORIST? So why isn't USA launching an attack on such countries???

Just dont get why people give communal/party overtones to charges of corruption.Yes decisions taken appear to be malafide with intention to cater to certain interests pawning the states.To call all such anti this and pro that is plain disgusting.Why cant they ever be a healthy exchange of views on the whole dam thing.Dislike to a regime is a part of ones own views to stoop below the permissable limits is nauseating.Why does Akil not ask Shivraj why his govt paid 4.25/unit of power without floating a tender ,when the unit paid under tender was just 2.25/unit.The loss to the state 2750 crores,is that ok with him.May be.Yes selling something at 2001 rates is indefensible,may be the CBI inquiry and public pressure there on will have the man disgraced as he is already.

Personnel integrity of MMS may be extremely high. He may have NOT taken money himself but allowing corruption all around him and then issuing "certificate" while investigation by CBI is in progress cast the shadow of doubt on the PM too. Will any CBI officer dare to come out with evidence against a "Minster who has been given character certificate" by PM especially when it is PM who holds the posting, promotion and the punishment powers of all CBI officials??? After all CBI officials are ordinary Govt Servants whose family would be put to extreme distress if the official is transferred FOUR times in TWO years.

This ill gotten wealth also would have been parked in the SWISS BANKS which would be difficult to be traced due to non-cooperation of the SWISS BANKS. Millions of poor are starving in rural India and committing suicide for want of food but the "bleeding heart CHRISTIAN SWISS BANKERS" has no problems about accepting "blood money generated by snatching food from the mouth of starving millions" in India . Why does the PM not approach the "POPE" to excommunicate all SWISS "CHRISTIAN" BANKERS, for accepting "stolen wealth" especially when more than 86% of the population of Switzerland is Christian?? There are ITALIANS and HALF ITALIANS at the helm of affairs more powerful than the PM who can also approach the POPE to put pressure on the SWISS BANKS to return the "corruption generated wealth of Indian" stashed in Swiss CHRISTIAN Banks. Will they do it???

it may give some fodder for media, opposition for some time to talk, report. there will be lot of noise made for some time for times to come. people who have made money politicians and the minons who helped them will keep laughing all the time.
nothing will come out of it. what happened to bofors after a quarter of century. may say it resulted in election being lost. we have come down the road of globlisation far too much. this scam may have helped and will help in winning more elections. so good luck to all following it in media and other concerned bodies; you will keep us entertained for some more time. good luck

Graft is endemic in India and it has become habitual to grease the palms- of politicos to the peons at the lower rug of various government levels-to get things done. Graft is widespread all over the world in various forms. As long as geed is there, graft will follow as a shadow.

Unless Manmohan Singh explicitly repudiates this statement by Rajah, one is forced to conclude that either Manmohan knew about the corruption or he is grossly incompetent.

The Spectrum charges came right in 2008. As a PM, it is his duty to see his ministers are conducting affairs ethically and legally. Once charges are being raised about corruption, it is the duty of PM to demand explanations from his minister. And if the explanations are unsatisfactory, he should dismiss him.

The question is whether Manmohan demanded explanation from Rajah. If yes, does he agree with it. If he did not demand an explanation from Rajah, what does he think his job as PM his?

For first 40 years of India's existance Congressi convinced Indians that the best you can do is 3% growth and public restriction on everythign where you have to stand in queue of licence going in years for scooter for telephone line for more or less everything of basic need. You are destined to existance of openury and you can do no better. Indian population bereft of self belief bought this argument and kept electing congressi who snoozed in office.

Then came the jolt of bankrupcy and IMF/Wb woke these sleeping politicians by forcing liberaltion and globalization and capitalism down their throat. it's another matetr that Manmohan Singh and congress now struts around lecturing people how it was their foresight that brought liberalization.

Now behind the personal financial integrity fo Manmohan congress has convinced people that corruption is part of life and indians should overlook rampant corruption of congress.. yes Corruption of opposition and other party is still to be scritnized. Case in point nearly everyday hounding of Maywati. Even thousand Maywati won;t come close to corruption of congress over years.

So now we haev people lecturing us since Manmohan Singh doesn't himself take money so everythign going under his name must be condoned..
(1) We must not say a word if our PM has nothign to say over one of his cabinet minsiter absconding under arrest warrant - Shibu Soren.. In fact m,anmohan Singh told us Shibu Soren was amongst masses serving the while he was underground.
(2)We are not supposed to ask question if manmohans Singh releases bfors kickback of Quttrochi and very next day lectures us how big fihs do not get caught in India
(3) Same Manmohan Singh while CBI is lookign into the matetr has given clean chit to one of hsi colleages financial thuggery.. I wonder whn is the next lecture of Manmohan ruing how big fish do nto get caught.

Bottomline Manmomhan's peronal integrity aside he easily has presided over one of the most coprrupt adminstration in fact his personal integrity works as shield to hide all the corruption that happens in thsi adminstration..

SeriouslY manmohan Singh seems has sold his soul. How can a PM give clean chit to hsi cabinet colleageu even before CBI has concluded its invetigation and in same breathe even pine how in India big poticians are neer held accountable for their crime.

This scam too will follow the path of how the Bofors that meticulously shunted by the vested interests.The media dosent seems to be keen to nail the government on this.Thats understandable.The CBI is also a government agency known to have been used by the congress to nail its rivals.The heat will die down sooner or later.

Indigent BJP leaders like promod Mahajan became billionaire from corruption which was very visible from his lifestyle. Just check MMS assets and see how he is living. Just wish that Dr MMS restores his credibility by silently allowing the CBI to get to those behind the scam.Do understand that the least that can be done as in the case of Mahajan and Yeshwant both tainted ministers lost the job.The same must be done with Raja as well,why should he be spared.MK must act as he did in the case of NKK Raja who was sacked after the land grab scam.This is no different.

Yes Raja is not innocent ,to paint MMS with the slur is no way to deal with the whole scam.Wish to ask Ganesan if the previous regime was free from any scams,Wasnt Mahajan removed when he wrote of the license fee of all Telecom operators which was due after the licences were given.Have u forgotten the UTI scam when a share price was jacked up and the promoters sold it and let me tell u that Yeshwant lost his job as FM.Does that mean that vajpayee got a cut from the whole scam.How can u be so dam intemperate.Whatever any wrong doer must be punished.To drag MMS is plain insane.

How do you know Manmohan Singh is personally honest? What other explanation is there for releasing Q and giving a clean chit to Raja-that Manmohan Singh's hand is as dirty as the minister?

That Manmohan Singh is personally honest is a media template. If he is really a man of honesty and integrity, he would not have allowed Soren to be a minister, the incidents in Goa, Bihar and Jharkhand would not have happened, he would not have allowed the PMO to be used to get petroleum contracts for TRBaalu and Raja would not be a minister.

How things have changed in the last 10 years!!!

Jayalalitha was voted out of office in 1996 on the issue of corruption. She herself lost her seat.

In 1998, Vajpayee made a very stupid move to include Sedapatti Muthaiah as a cabinet minister. There were cases against him. A great uproar ensued and Vajpayee was forced to drop him out of the cabinet.

Ten years later, the wheel has indeed come full circle. People of Tamilnadu vote to the highest bidder. Corruption is no longer an issue since the people are themselves corrupt. And we have a PM who is defending a corrupt minister. And the most scary of all-there wont be any penalty for defending a crook.

Eternal vigilance is the price of democracy and our people put Kumbhakarna to shame.

When the PM himself has openly declares that Mr Raja is innocent why carry on the facade of investigation by CBI and waist govt fund. Will any CBI officials ever have the courage to catch the "corrupt" after PM's statement? Honesty is NOT being personally honest alone, it is also the courage to take action against dis-honest, an area which is found wanting in Mr Manmohan Singh.

THis is total BS and Jaitley knows it. Indian voters do not care about corruption-or any other issue for that matter. Had they cared about corruption and govt efficiency, DMK would not have got one seat in the last election.

Yeah right! As though Manmohan Singh worries about norms and ethics!!! He was they guy who had Shibu Soren as a minister after the dude went underground.

Why is corruption an issue? After all the spectrum scam broke out before the elections involving a TN minister. And people of TamilNadu accepted bribe from DMK and voted for DMK and Congress.

The simple fact is people have lost all right to complain about corruption and terrorism-since they do not expect their officials to act on those issues.

As for Manmohan Singh, he has presided over the most corrupt govt in Indian history-surpassing Narasimha Rao and Indira Gandhi. The only question that remains is how much did Manmohan Singh get out of the scam.

I believe he took money from Q to let him off the hook. And I am sure he got a certain percentage from the Spectrum scam. There is no other explanation as to why he looks the other side on this issue.
